Terms of Service

1. Scope of services

We provide contractor-side contractual and commercial support services, including assistance with NEC and JCT contract administration, variations, compensation events, claims preparation, dispute support, and related commercial documentation.

Any work undertaken is limited to the agreed scope confirmed in writing (email is sufficient) or otherwise evidenced by instruction.

2. Contractor-side only

Our services are provided on a contractor-side basis only. We do not accept instructions that conflict with this position.

3. Not legal advice

We are not a law firm and do not provide legal advice. Any commentary provided is commercial and contractual in nature and is based on the information available at the time.

You should obtain independent legal advice where appropriate, particularly where formal dispute proceedings are contemplated.

4. Not expert witness (unless separately instructed)

We do not act as an expert witness unless we have agreed this in writing under a separate instruction and scope. Unless expressly stated, our work is prepared for commercial purposes and is not intended to be relied upon as expert evidence.

5. Information provided by you

You are responsible for ensuring that information, documents, records, and instructions you provide are accurate, complete, and up to date. We are not responsible for outcomes arising from incomplete, incorrect, or late information.

6. Deadlines, notices, and time bars

Contractual deadlines and time bars can be strict. While we can help identify and manage notice requirements, you remain responsible for ensuring that notices and submissions are issued on time.

Where urgent support is required, you must clearly highlight the deadline and provide all relevant contract clauses and communications immediately.

7. Fees and payment

Fees may be agreed as hourly rates, fixed fees, or staged deliverables depending on the instruction. Unless otherwise agreed, invoices are payable within the timeframe stated on the invoice.

We reserve the right to pause work if invoices remain unpaid beyond the due date.

8. Limitation of liability

To the maximum extent permitted by law, NAT QS SERVICE LTD will not be liable for indirect or consequential losses, loss of profit, loss of opportunity, or business interruption.

Our total liability arising out of or in connection with any instruction (whether in contract, negligence, or otherwise) shall be limited to the fees paid for the specific service giving rise to the claim.

9. Confidentiality

We will treat information provided by you as confidential and will not disclose it to third parties except where required to deliver the agreed services, or where disclosure is required by law.

10. Intellectual property

Unless agreed otherwise, all templates, formats, and working methods remain our intellectual property. You may use deliverables provided to you for your project and internal purposes only.

11. Website use

You may use this website for lawful purposes only. We do not guarantee that the website will be uninterrupted or error-free. Content is provided for general information and may be updated without notice.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
