Delay and prolongation are not the same thing
Delay usually concerns time impact. Prolongation concerns the time-related costs that flow from a compensable delay. Contractors often weaken claims by blending these concepts without clearly proving either.
What can be claimed
- Time-related preliminaries where properly evidenced.
- Defined Cost under NEC where the event qualifies.
- Loss and expense under JCT where entitlement is established.
- Additional resources where causation and records support recovery.
