Delay and prolongation are not the same thing

Delay usually concerns time impact. Prolongation concerns the time-related costs that flow from a compensable delay. Contractors often weaken claims by blending these concepts without clearly proving either.

What can be claimed

  • Defined Cost under NEC where the event qualifies.
  • Loss and expense under JCT where entitlement is established.
